贝朗医疗获得针对Poly Medicure误导性广告宣传的临时禁令

德国梅尔松根2017年11月22日电 /美通社/ -- 贝朗医疗(B. Braun Melsungen AG)已经针对印度公司Poly Medicure Ltd.的不正当竞争成功宣示索赔，后者主要是进行了误导性广告宣传。Poly Medicure在科隆MEDICA贸易展上分发了广告材料，而这些广告材料中某些带有™符号的产品名字/图形实际上并没有得到商标保护，或是提交各自的商标申请。针对这种情况，贝朗医疗在2017年11月15日从科隆地区法院(Regional Court of Cologne)那里获得了一项临时禁令（案卷编号：33 O 181/17），之前Poly Medicure已经拒绝了贝朗医疗的索赔。上述临时禁令由科隆地区法院在事先没有召开听证会的情况下发出，该法院已经知晓Poly Medicure在回复贝朗医疗的警告信中所提出的论据。贝朗医疗直接在MEDICA贸易展上执行了临时禁令，法警针对Poly Medicure现场送达了禁令文件。不过上述裁决并不是最终结果。
